Mohamed-Annas Bennis was gunned down by a Montreal police officer in Cote-des-Neiges in December of 2005.
The officer was cleared of criminal charges after investigation showed Bennis had attacked him with a knife.
The Bennis family was awaiting a public inquiry, due to begin this fall but now its been delayed.
Injunction
The police brotherhood has filed a motion to block the coroner's investigation, saying the officer's rights must also be respected.
“He was absent for almost 12 months,” said union president Yves Francoeur.
“Right now he's back on the road, but he'd like to be able to work without more inquiries.”
Bad precedent?
The coroner in the case says she's worried the motion to block her inquiry could set a precedent.
A Quebec Superior Court judge will hear from both parties in January -- the inquiry is currently set to go ahead in March.
